State Council resolution on the draft of the amended Act on Promotion of Information and Communications Network Utilization and Information Protection for promulgation The Korea Communications Commission (KCC, Chairman Kim Hong-il) announced that the draft of the partly amended Act on Promotion of Information and Communications Network Utilization and Information Protection (Network Act), which calls for providers of information and communications services who install and operate servers which temporarily store data and whose size is exceeding a certain standard in Korea to take technical and administrative measures to effectively block the distribution of illegal information, will be approved at the State Council meeting on Tuesday, January 16 and will take effect six months after the date of promulgation. It has been pointed out that even if access to websites where illegal information is distributed is blocked after deliberation and decision by the Korea Communications Standards Commission (Chairman Ryu Hee-lim), domestic users can bypass and access the illegal information if the data is dispersed on the network as website operators use the Content Delivery Network (CDN)*. * Content Delivery Network: CDN provides high availability to content by duplicating original content, installing multiple content on the network and distributing the service spatially. In accordance with the amended Network Act, companies obligated to take technical and management measures must take measures such as quickly restricting access to illegal information on temporary storage servers, requesting prohibition of distribution to publishers of illegal information, and automatic records of management status. If they do not take these measures, a fine of up to 10 million won will be imposed. Chairman Kim said, "The amended Network Act is expected to lay the foundation for eliminating blind spots not only for copyright infringement but also for illegal information such as drugs and gambling." He added, "We will thoroughly prepare for the amended Enforcement Decree that follows the Network Act amendment, aiming to enhance the effectiveness of laws and systems in eradicating illegal information from the Internet." ### The Korea Communications Commission |
