Agencies cooperate to prevent circulation of digital sexual crime


November 12 - The Korea Communications Commission, the Ministry of Gender and Family Affairs, the Korean National Police Agency, and the Korea Communications Standards Commission met at KCSC to sign the “Agreement on Joint-Response to Digital Sexual Crime.”

This agreement was concluded to strengthen the cooperative framework between relevant organizations following recent efforts to improve response to sexual crime, including the KCSC’s upgrade of the “Digital Sexual Crime Response Team” to “Digital Sexual Crime Evaluation Support Team” (on September 1) and the creation of a 24 hour response system (with a 24 hour monitoring room). Through this agreement the KCC and other organizations will strengthen efforts to prevent distribution of digital sexual crime and protect victims.

Cooperation for 24 hour response to digital sexual crime

First, the KCSC will operate a 24 hour monitoring room as part of the Digital Sexual Crime Evaluation Support Team and introduce a dedicated sub-committee facilities and e-system to strengthen the hotline with the MOGEF (Support Center for Victims of Digital Sexual Crime), KCC (KAIT) and Korean National Police Agency. Receiving information from the various agencies regarding digital sexual crime video content and orders for deletion or blocking, and operating a monitoring room that supports swift evaluation is expected to result in swift action against digital sexual crime.

* Support Center for Victims of Digital Sexual Crime : Provides customized consultation, support for deleting content, investigation support, connections to legal and medial support for victims of digital sexual crime
** (KAIT) : Given responsibilities by the kCC to check whether webhard and P2P operators are complying with their technical measure mandates according the Telecommunications Business Act Article 22(3)

The KCSC and the Support Center will prepare for the rest of this year to receive requests for evaluation of sexual crime video content through the ‘Deletion Support System’ (temporary name). Until now, the KCSC received requests through its main complaint office (excluding cases received from the Police Agency’s system to track illegal filmed content), but there were significant inconveniences in having the main complaint office process large volumes of information related to victims.

Public DNA Database

Furthermore, as discussed at the “Meeting for Measures to Prevent Webhard Cartel” held at the National Assembly on January 24, there are plans to improve the efficiency of webhard filtering by creating a Public DNA Database with the KCSC, KCC, MOGEF and Policy Agency.

* Public DNA Database: Have the KCSC compile and manage the illegally filmed material and child pornography received by the Police Agency, KCC (KAIT), MOGEF, and serve as a database for commercial filtering companies to use in their filtering services.

To this end, on July 11 the MOGEF and Police Agency signed an agreement, and the MOGEF’s Support Center for Digital Sexual Crime was given authority to access the Police Agency’s Tracking System for Illegally Filmed Material. This allows for coordination by both agencies to support victims, through registering and categorizing suspicious or illegally filmed material, and process delete or blocking requests.

The KCC (KAIT) also received access to the tracking system through this agreement, and the KCC will be able to register digital sexual crime video collected through its monitoring efforts into the Police Agency’s system.

The material collected by the Police Agency, MOGEF, and KCC will be transferred and saved in real time to the KCSC’s Public DNA Database.

With the Public DNA Database, the following will be possible: the Police Agency will be able to investigate webhards in more detail based on the information on circulation of illegally filmed material provided by the MOGEF, KCC and KCSC; the MOGEF will be able to easily find the distribution websites and more efficiently protect and support victims.

Additionally, the KCSC will apply the illegal video material (provided by the Police Agency, KCC, MOGEF) to the webhard filtering service. The KCC (through KAIT) will use the database’s information to evaluate whether webhard operators technical measures comply with their mandated responsibilities, thereby allowing for swift blocking of illegally filmed material or child pornography on webhards.

Minister of MOGEF LEE Jung Ok emphasized “the government recognizes the need to swiftly and strictly respond to illegally filmed material and child pornography being distributed on the dark web,” adding, “today’s agreement is very encouraging considering the importance of inter-agency cooperation. Moving forward, the government will break down silos and work together to end digital sexual crime.”

KCC Chairman Han Sang-hyuk commented, “the KCC will spare no effort in cooperating to realize today’s agreement and building the public DNA database, and strive to eliminate digital sexual crime content which destroys human dignity.”

Police Agency Commissioner General Min Gab Ryong said, “the Police Agency will make a cyber sexual violence investigation team with local agencies, and develop a collection and tracking system for child pornography and illegal filmed material circulating on the dark web. We will strictly respond to digital sexual crime so that perpetrators know they have no place to hide.”

He added, “considering the importance of support and protection for victims, in addition to arrests of criminals, we will share information and knowledge regarding the operations of the tracking system for illegally filmed material with relevant ministries and contribute to the building of the public DNA database.”

KCSC Chairman Kang Sang-Hyun commented “this agreement will create a one-stop service to allow for more swift and practical support for victims. In the future, all the agencies will cooperate to prevent harm from digital sexual crime.”
