First On-Site Inspection Results: Corrective Orders and Fines Imposed on Seven Companies, Including Twitter and Google Administrative dispositions have been imposed on companies, including Twitter (X), Google, and Meta, for violating obligations to prevent the distribution of illegally filmed materials. The Korea Communications Commission (KCC, Chairperson Lee Jinsook) held the 4th KCC Meeting of 2025 and decided to impose corrective orders and fines on seven companies that did not comply with the technical and managerial obligations under the Telecommunications Business Act. Following the Nth room case that occurred in 2019, technical and management obligations have been imposed on value-added telecommunications business operators under the Telecommunications Business Act. Over the last two years since 2022, the KCC has conducted its first on-site inspection of the 91 business operators obligated to take preliminary measures. The KCC reviewed the following through the inspection: ▲ Establishing a reporting function for illegally filmed materials ▲ Restricting illegally filmed materials from appearing in search results ▲ Restricting the publication of information after comparing and identifying whether it corresponds to illegally filmed materials ▲ Issuing advance warnings regarding the distribution of illegally filmed materials The inspection confirmed that while all 91 business operators appropriately implemented measures for establishing a reporting function, restricting illegally filmed materials from appearing in search results, and issuing advance warnings regarding the distribution of such materials, seven operators failed to comply with the requirement to conduct the comparison and identification process before publishing information. Specifically, the KCC imposed corrective orders and fines of 15 million won on operators that did not implement the comparison and identification process before publishing information. Among the five operators that conducted comparison and identification only after publication, three received corrective orders, while the other two operators with minor violations were subject to administrative guidance. Furthermore, for one operator that implemented the comparison and identification measure but failed to meet technical performance standards, such as technology performance assessments, the KCC issued a corrective order. The comparison and identification process before publishing information is a measure to restrict the publication of information by analyzing its characteristics before users post it and determining whether it corresponds to illegally filmed materials as deliberated and decided by the Korea Communications Standards Commission. The inspection was conducted on business operators that provide search engine services and information uploading and sharing services, such as web hard drive (online storage and file-sharing) services, social networking services (SNS), online communities, and video-sharing platforms. The 91 value-added telecommunications businesses, with either annual sales of one billion won in the previous year or more than an average of 100,000 daily users over the last three months of the previous year, were subject to inspection. While the KCC focused on whether business operators were implementing technical and managerial measures during the inspection, it also evaluated whether they had self-regulatory measures, such as plans to prevent the distribution of illegally filmed materials, monitoring of illegally filmed materials, and internal training programs. The KCC explained since this was the first inspection conducted after the implementation of the Act, it considered the efforts made by operators to resolve violations during the supplementary inspection held about a year after the initial inspection conducted in 2022, as well as the need encourage continuous investments and efforts from operators into its decision on penalties. KCC Chairperson Lee Jinsook stated, “Digital sex crimes, such as the distribution of AI-generated sexual deepfakes, continue to occur.” She emphasized, “The government and internet service providers must strengthen their efforts so that the enforcement of the Act becomes an opportunity to eradicate the distribution of illegal content.” ### The Korea Communications Commission |
