188 business operators violated the Act on Protection and Use of Location Information 856 million won of penalty surcharges and 345 million won of administrative fines The Korea Communications Commission (KCC, Chairman Kim Hong-il) held a plenary meeting on Wednesday, June 12, and imposed penalty surcharges of 856 million won and administrative fines of 345 million won on 188 operators who violated the Act on Protection and Use of Location Information. This administrative disposition is in accordance with the "2022 Regular Status Inspection on Location Information Business Operators Results" on matters, such as protecting location information, destruction of personal location information, and registration of location information businesses, under the amended Act on Protection and Use of Location Information in 2022, and a total of 1,287 businesses, including 278 personal location information business operators, 32 object location information business operators, and 977 location-based service providers are the subjects. According to the inspection, a total of 353 violations included 229 location-based service providers, 117 personal location information providers, and 7 object location information providers. The types of violations included 150 approvals or report violations for the closure of a business, 54 management and technical protection measure violations, and 45 terms and conditions specification violations. The KCC imposed penalty surcharges of 856 million won on 52 operators that violated the Act on Protection and Use of Location Information, such as Apple and Google, administrative fines of 345 million won on 156 operators, and ordered 14 operators to take corrective action for violations. Regarding this administrative disposition, the KCC determined that a strict disposition was necessary for business operators that lacked location information protection measures to protect the privacy of users. However, for business operators that have improved the matters themselves, the KCC will induce voluntary improvement efforts by reducing the disposition. In addition, the KCC said it planed to further strengthen measures to protect the rights and interests of location data subjects and actively promote business support measures to improve user benefits and facilitate the location information industry, apart from location information protection regulations. ### The Korea Communications Commission |
