The KCC prepares an amendment to the Enforcement Decree of the Network Act The Korea Communications Commission (KCC, Chairman Kim Hong-il) has prepared an amendment to the Enforcement Decree of the Act on Promotion of Information and Communications Network Utilization and Information Protection that stipulates the scope of "information and communications service providers that temporarily install and operate servers that store data in Korea" and necessary measures to prevent the distribution of illegal information. This amendment is to remove blind spots of blocked websites where overseas illegal website operators may provide illegal information indirectly through a domestic transient storing server. The revision of the enforcement decree was prepared as a follow-up measure as legal grounds, such as the obligation to take technical and administrative measures to prevent the distribution of illegal information were newly established for information and communications service providers who install and operate servers that temporarily store data in Korea in January. Major content of the amendment to the Enforcement Decree of the Act on Promotion of Information and Communications Network Utilization and Information Protection First, the scope of "information and communications service providers that install and operate servers that temporarily store data in Korea" is defined as those with more than one billion won in sales in the information and communications service sector among content delivery network operators (CDN operators) to clarify the subject of the amendment. ※ Content Delivery Network (CDN) refers to a service that efficiently accesses content by replicating the original content, installing multiple of them on the network, and distributing the access. Second, the storage period for the operation and management status of illegal information access restrictions by CDN operators is stipulated to be two years. Third, necessary measures to prevent the distribution of illegal information by CDN business operators include establishing guidelines for designating a person responsible for preventing the distribution of illegal information and specifying the responsibilities and duties of the person, and establishing procedures for reporting receipt and processing at ordinary times. The content, procedures, and details of these measures have been stipulated in the terms of service. The KCC will collect opinions from all walks of life through a legislative announcement on the amendment in the future and will promulgate and implement it in July. The KCC said it plans to continue to make efforts to eliminate blind spots of illegal content blocks and create a healthy Internet environment through the revision of the Enforcement Decree of the Act on Promotion of Information and Communications Network Utilization and Information Protection. ### The Korea Communications Commission |
