Temporary suspension of six regulations related to broadcasting and communications
The Korea Communications Commission (KCC, Chairman Kim Hong-il) will push for six temporary regulatory suspensions in 2024 to boost the vitality of the broadcasting and communications industry. The temporary suspension of regulations is to forbear regulations (easing, suspending, special cases, etc.) for a certain period, while maintaining the basis of existing policies. The KCC implemented five similar cases in 2016, including the abolition of the mandatory programming ratio of outsourced products of terrestrial mobile multimedia broadcasting (DMB).
First, in the area of 'everyday regulations,' the required programming ratio for listener participation programs on community radio is being reduced. This decision aims to enhance the programming autonomy and efficiency of community radio broadcasters by lowering the mandatory ratio of listener participation programs from 20% to 5%.
Second, in the field of 'boosting SMEs,' monitoring of small mobile phone distributors will be reduced. Although unfair sales and user discrimination are currently being monitored nationwide throughout the year, it is expected that the burden will be reduced by reducing the number of monitoring of micro and small retailers that have not violated the Mobile Device Distribution Improvement Act over the past three years, thereby ensuring the autonomy of distributors.
Third, in the field of 'boosting SMEs', when transmitting advertising information, the obligation of small business owners to obtain prior consent is suspended. Under the Act on Promotion of Information and Communications Network Utilization and Information Protection, explicit prior consent is required when a business operator transmits commercial information to a user for commercial purposes. However, if a user calls the business, such as a reservation inquiry, it is regarded as prior consent for the transmission of advertising information. Small business owners who suffer from economic difficulties due to the economic recession are expected to reduce their operating burden by using services that automatically send promotions (business hours, location, events, etc.).
Fourth, in the field of 'promoting investment and start-ups,' regulations on production sponsors for broadcasting programs will be relaxed. The KCC intends to promote the relaxation of the standard for notification of production sponsors (production cost per broadcast program, number of programming, etc.) that have been applied only to some broadcasting programs of the three terrestrial broadcasters.
Fifth, in the field of 'reduction of the management burden,' the mandatory programming ratio for fully outsourced programs of regional broadcasters will be relaxed. By easing the mandatory programming ratio, which was 3.2% for regional private broadcasting and 20% for regional MBCs, the KCC aims to lower the production cost burden on regional broadcasting companies and promote self-production to promote regional features.
Sixth, in the field of 'reduction of the management burden,' the report documents for the person in charge of broadcasting programming are simplified. Previously, when the person in charge of broadcasting programming has been changed, the same evidence as the case in which the representative has been changed was required, but the person in charge of broadcasting programming is exempted from submitting a family relation certificate and resume as the position has fewer to check.
In principle, the effective period of temporary suspension of regulations is two years, but the period is flexible in consideration of the characteristics of each task. Necessary measures, such as the revision of an enforcement decree will be carried out in the first half of the year for prompt implementation. In addition, two months before the expiration of the implementation period, the commission plans to comprehensively review the effect of the suspension for each task to determine whether to extend, improve further, or lose effectiveness.
