Title KCC APPROVES AMENDMENTS TO THE ENFORCEMENT DECREE OF THE NETWORK ACT, ESTABLISHING A LEGAL BASIS FOR CONNECTING INFORMATION SERVICES

The KCC held the 2nd Plenary Session of 2025, mandating the measures to prevent illegal information distribution and strengthening obligations to prevent spam.

The amendment to the enforcement decree was decided to ensure the continued provision of safe and convenient online services for the public, including mobile electronic notice and MyData. It requires Content Delivery Network (CDN) providers to prevent the spread of illegal information and strengthens the obligation of information and communications service providers to prevent spam.

The Korea Communications Commission (KCC, Chairperson Lee Jinsook) held the 2nd Plenary Session of 2025 on the 12th and approved partial amendments to the Enforcement Decree of the Act on Promotion of Information and Communication Network Utilization and Information Protection (hereinafter referred to as the “the Network Act”).

The key amendments, which specifically stipulate the details delegated by the Network Act that took effect in July last year, are as follows:

First, the amendment designates mobile electronic notice and financial MyData services?which were temporarily allowed only under regulatory exceptions?as services eligible for approval to generate and process Connecting Information (CI), thereby ensuring the consistent and stable provision of the services.

The amendment also establishes fair and transparent approval examination procedures by specifying detailed examination standards and approval processes for generating and processing CI, including required application documents, and the examination period. CI refers to encrypted resident registration numbers used to identify individuals.

Additionally, the amendment secures the stability of the generation and process of CI by specifying physical, technological, and management measures that CI-generating agencies must implement, as well as the safety measures required for agencies that use CI.

The mobile electronic notice service enables government agencies, public institutions, and private organizations to send and check various notices, such as property tax payment notices from local governments, military duty notices from the Military Manpower Administration, and medical health check-up notices from the National Health Insurance Service.
The financial MyData service facilitates the management of assets and credit by consolidating all scattered personal credit information into a single platform.

Second, CDN providers with sales exceeding 1 billion won in the information and communications service sector must implement measures to prevent the spread of illegal information.

The measures include designating personnel responsible for technological and management measures, notifying illegal information distribution reports to the Korea Communications Standards Commission, and stipulating the regulations prohibiting illegal information distribution in contracts or terms and conditions.

Third, the amendment sets a detailed criterion for imposing fines based on a number of violations, as the maximum fine imposed on information and communications service providers violating spam prevention obligations has increased from 10 million won to 30 million won. (first violation: 7.5 million won, second violation: 15 million won, third violation: 30 million won)

The Director General of the KCC Consumer Policy Bureau, Shin Young-kyu, stated, “The KCC will spare no efforts in creating a safe and convenient online service environment for the public by swiftly implementing follow-up measures of the amendment decided today.”
